1. Service overview

ToGather is a social matchmaking application published by 2G Labs (SASU — SIREN 101 862 951), intended exclusively for adults (18 years and older) residing in France. Our service allows you to meet authentic people and share moments without commitment, in a friendly and respectful environment.

Using ToGather is free and without obligation to purchase. No paid subscription is required to access the application's main features.

2. Acceptance of terms

By using ToGather, you fully accept these Terms of Service (TOS). If you do not agree to these terms, please do not use our service.

2G Labs reserves the right to modify these TOS at any time. Modifications will take effect as soon as they are published on the application. It is your responsibility to regularly check these conditions.

3. Conditions of access

3.1 Age and legal capacity

To use ToGather, you must:

• Be at least 18 years old
• Have the legal capacity to enter into a contract
• Not be prohibited from using our service

3.2 Account creation

When creating your account, you commit to:

• Providing accurate, complete, and up-to-date information
• Creating only one personal account
• Maintaining the confidentiality of your login credentials
• Notifying us immediately of any unauthorized use of your account

4. Use of the service

4.1 User commitments

By using ToGather, you commit to:

• Complying with applicable laws and regulations
• Adopting respectful behavior towards other users
• Not using the service for commercial or promotional purposes
• Not publishing illicit, offensive, defamatory, or inappropriate content
• Not impersonating another person
• Not harassing, intimidating, or threatening other users

4.2 Published content

You are solely responsible for the content you publish on ToGather (photos, messages, profile information). You guarantee that you hold all necessary rights to this content and that it does not infringe upon the rights of third parties.

2G Labs reserves the right to moderate, delete, or refuse any content that violates these TOS or is reported by other users.

5. Free service

ToGather is a free application. Access to the core features does not require any payment or subscription. Optional paid features may be offered in the future, but subscribing to them will never be mandatory to use the basic service.

6. Liability and warranties

6.1 Limitation of liability

ToGather is a matchmaking platform. 2G Labs is not responsible for:

• Physical meetings between users
• The behavior of users outside the application
• The accuracy of the information provided by users
• Indirect damages resulting from the use of the service

6.2 Non-liability during physical meetings

ToGather is exclusively a digital matchmaking tool. 2G Labs declines all responsibility for any incident, accident, physical, moral, or material harm occurring during physical meetings organized between users, regardless of the cause or nature.

Each user is solely responsible for their actions, personal safety, and the consequences of their meetings with other users. 2G Labs does not supervise, endorse, or control physical interactions between users in any way. It is the responsibility of each user to take necessary precautions before and during any meeting, particularly by informing a loved one of the location and time, and by choosing public places.

In the event of an incident during a meeting, users are encouraged to contact the competent authorities (police, emergency medical services, etc.) and can report the situation via the reporting function on ToGather (reporting a user and/or a meeting) or by email at [email protected].

6.3 Non-liability regarding message exchanges

Messages exchanged between users within the application are private communications strictly under the responsibility of their authors. 2G Labs cannot be held responsible for the content of messages sent or received, nor for their consequences (moral harm, harassment, scams, etc.).

In the event of receiving illegal, threatening, harassing, or offensive messages, the user is encouraged to use the reporting and blocking features available in the application, and to contact competent authorities if necessary. 2G Labs will process any report as soon as possible and reserves the right to suspend or ban any account responsible for such behavior.

6.4 Service availability

2G Labs strives to keep ToGather accessible 24/7, but cannot guarantee uninterrupted availability. The service may be temporarily suspended for maintenance or in the event of force majeure.

7. Suspension and termination

2G Labs reserves the right to suspend or terminate your account at any time, without notice, in the event of:

• Violation of these TOS
• Inappropriate or fraudulent behavior
• Abusive use of the service
• Repeated reports by other users

You can also delete your account at any time from the application settings.

In the event of a ban (particularly for abusive use of the service, violation of these TOS, or requirements linked to legal proceedings), necessary user data is retained for an indefinite period. This retention may be limited upon exercising your GDPR rights, within the limits of applicable legal provisions, particularly when legal proceedings are ongoing.

8. Intellectual property

All elements of ToGather (logo, interface, editorial content, etc.) are protected by intellectual property rights belonging to 2G Labs. Any reproduction, representation, or exploitation, even partial, is strictly prohibited without the prior written consent of 2G Labs.

10. Applicable law and jurisdiction

These TOS are subject to French law. In the event of a dispute, and failing an amicable resolution, the French courts will have exclusive jurisdiction.

11. Security, Integrity and Prosecution

11.1 Formal prohibitions

It is strictly prohibited, under penalty of an immediate, permanent ban without notice, to:

• Conduct penetration tests (pentesting), port scans, or vulnerability research without a legal mandate or prior written authorization from 2G Labs.
• Attempt to fraudulently access or maintain access to all or part of the automated data processing system (STAD).
• Engage in "scraping," automated data extraction, or reverse engineering of the ToGather API.
• Launch Denial of Service (DDoS) attacks or any action aimed at disrupting the operation of the service.

11.2 Systematic Legal Proceedings

In accordance with the provisions of Articles 323-1 to 323-7 of the French Penal Code (Loi Godfrain), any attack or attempted attack on 2G Labs' systems will result in a systematic formal complaint to the police or gendarmerie, as well as to the Public Prosecutor.

We remind you that these offenses are punishable by sentences of up to 5 years of imprisonment and a €150,000 fine (or more in the case of organized crime).

Furthermore, 2G Labs will constitute itself as a civil party to claim damages covering the entirety of the harm suffered (including reputational damage, technical investigation costs, and legal fees). No amicable settlement will be considered in the face of this type of offense.
